4. Is the apartment in bad shape? A tenant may be able to get out of a lease if the apartment is in a sub-standard state and repeated attempts to have repairs made have been ignored. Sub-standard could mean poor maintenance of the building and/or unit, public health concerns like water and mould, or harassment of a tenant by a landlord. In this case, as long as you have proof, the tenant board can order an end to the tenancy because “the landlord has not met their obligations.”
A: The pet policy should clearly outline the type of pets that are allowed (if any), how many of each type, and the expected care and cleanliness to be maintained if a tenant will keep a pet on the premises. You can also specify any rules regarding the pet and whether you have the right to change the pet agreement as long as you give proper notice (at least 30 days).
Section 14. The staff or the building manager may enter the Premises at any time in the event of an emergency. With two days prior notice, the Landlord or Landlord’s agents may enter the Premises at reasonable times and manners to make repairs or improvements, or to show the Premises to prospective buyers or tenants. The Landlord may also enter the Premises to conduct a semi-annual inspection to check for safety or maintenance problems.
The Ontario government is requiring all landlords to use a standard lease template for all new leases beginning April 30, 2018. Your Order will be processed no later than 5 (five) business days following the day the Order was confirmed and paid for on the Site. The length of time of a lease agreement is identified as one of the requirements of the contract. A lease agreement can be created for month-to-month leasing, six months, one year or more. Lease agreements are not required to be the same set amount of time. At the end of the current lease (fixed term) the landlord may wish to extend the lease to the tenant, as a lease agreement does not automatically renew, unlike a rental agreement. The current lease agreement will need to be amended or a new legally binding agreement can also be signed.


A rental agreement is extremely important for any landlord wanting to rent their property. Even if you are renting to a friend or family member, or just for a short time, a residential lease agreement can help save you from a lot of problems if (when) things don't work out. A rental contract should outline all your expectations for the renter, and it helps keep both the renter AND the landlord responsible and accountable for their part of the agreement.
Prior to moving in, the tenant and the landlord should walk through the premises and write down any existing damage. This written account is called an inspection report. The landlord and tenant should both get a copy of this report. In some jurisdictions, an inspection report is also required upon moving out, as a condition for the landlord to make a claim against the tenant's security deposit.

This is one of the most important reasons to read your lease in detail before you sign it! Take it home if you need to, and ask all the questions you need to clarify any terms in it that you're not sure about. You may want to beware of any landlord that is trying to rush you into signing or fails to respond to your concerns – if the landlord behaves this way before you've even moved in, imagine what it would be like if you were already moved in and needed repairs done, for example.
Panda Tip:  Customize these to your anticipated living conditions, and be sure the Renter is ready to meet your expectations of behavior.  Because a room renter is going to be living in daily close proximity, it is important for everyone to respect each other’s expectations of behavior.  Pay close attention to rules about pets and waterbeds as both have the possibility of causing serious damage to the property; say they are not allowed at all if that is the choice you decide to make.
When the tenant has broken the lease conditions and vacated prior to the expiry of the lease term, the landlord may charge a "rerent levy" to recover their lost rental income and costs associated with finding a new tenant. It is usually only charged when the term of the lease is six months or more, and some jurisdictions do not permit the landlord to charge a rerent levy. The amount charged must be reasonable given the circumstances, and must not exceed the damages that the landlord suffers from the tenant leaving early.
If these charges are not paid by the tenant, the Landlord may treat these unpaid amounts as non-payments of rent and start eviction proceedings against the tenant for non-payment of rent. If this clause was not in the contract, the Landlord could not treat a failure to pay these bills as a non-payment of rent and could not start and eviction process as quickly (or at all in some cases).
The tenancy cannot be ended earlier than the date fixed except in three circumstances:  both parties agree in writing;   there are special circumstances such as the tenant is fleeing family violence or the tenant has been assessed as requiring long-term care or has been accepted into a long-term care facility; or as ordered by an arbitrator. You must provide proper notice to the landlord that you do not intend to renew the lease, before the lease expires. Notice must be given a certain amount of time before the lease expires, as dictated by statute in your jurisdiction. This amount of time is called the "notice period". Typically, the notice period is one month for leases with a term of one month or less, and two or three months for leases with a term of more than one month, but this will vary according to the jurisdiction. You should consult the governing statute for the jurisdiction the property is located in to find out the required notice period for your lease.
Section 8: The Tenant is assigned (1) parking space. Parking space is designated as space # Parking Space #. The Tenant may only park a vehicle that is registered in the Tenants’ name. The Tenant may not assign, sublet, or allow any other person to use this space. This space is exclusively used for the parking of passenger automobiles by the Tenant. No other type of vehicle or item may be stored in this space without prior written consent of the Landlord. The Tenant may not wash, repair, or paint in this space or at any other common area on the premises. Any vehicle that is leaking any substance must not be parked anywhere on the premises.
No refund will be issued to the CLIENT or any person connected with any advertisement being the subject of a publication on the Website of RENTQUEBECAPARTMENTS.COM or RENTQUEBECAPARTMENTS.COM MAGAZINE, and that is even if the good is rented or if the advertisement relating to the good is no longer required and/or needed by the CLIENT, before the end of the period of publication engaged of the advertisement.
If you are planning to sublet your place its important to know that you remain entirely responsible for the obligations of the lease. That said, you can draw up a sublease form by using a standard lease form and fill it out as the landlord. Let your landlord know you are planning to sublet your place and notify them of your sub-tenant nomination. They are allowed to refused the sub-tenant provided they offer serious explanations. A sublet is a sublet (versus assigning a lease) only if you expect to return afterwards.

Additional occupants: The agreement may include a term restricting the number of occupants in a rental unit or requiring the landlord’s permission before additional occupants can live in the rental unit.  If additional occupants are added, a landlord can only increase the rent if the tenancy agreement includes a term allowing the rent to vary based on the number of occupants or the parties all agree to sign a new tenancy agreement.
